Holzapfel, Wolfe & McGuckin Bill Combating Animal Cruelty Clears Committee

Legislation sponsored by District 10 legislators, Senator Jim Holzapfel and Assemblymen Dave Wolfe and Greg McGuckin, that continues the legislators’ efforts to prevent the cruel treatment of animals has passed the Senate Economic Growth Committee.

“As legislators and pet owners, we are passionate about protecting animals from abuse,” said Senator Holzapfel. This legislation aims to prevent the chaining of animals for long periods of time rendering them defenseless and unable to care for themselves. That cruel and inhumane treatment is deplorable and must be stopped.”

Senator Holzapfel’s bill, S-1640/S-1642/S-1013/S-1060Scs, makes it unlawful to tether a dog that in a way that poses a risk of entanglement, strangulation, drowning or other harm to the health or safety of the dog. The legislation also requires the provision of proper shelter for a dog during severe weather conditions, and allows dogs found to be at risk of imminent harm to be taken into custody.

“This critical legislation allows for intervention to prevent the suffering of dogs that are tethered or left outside during extreme weather without access to proper shelter,” said Assemblyman Wolfe. “We’re sending a strong message to abusive pet owners and others who mistreat dogs that their abhorrent behavior will not be tolerated.”

In addition, the bill provides that when state or local officials issue an order of evacuation due to weather or other emergency conditions, the owner must make every effort to evacuate with the animal, and not leave the animal indoors or outdoors while unattended and tethered.

“Being tied to a rope or chained for hours on end or left defenseless in harsh weather conditions such as extreme heat, bitter cold, snow, rain and hail can be a death sentence,” stated McGuckin. “It’s time that we show ‘man’s best friends’ that we’re worthy of the loyalty and affection they give us.”
