Holzapfel, Wolfe & McGuckin Bill “Pet Purchase Protection Act” Signed Into Law

Animal Advocates Praise New Protections of Senate Bill 1870

Legislation sponsored by Senator Jim Holzapfel and Assemblymen Dave Wolfe and Greg McGuckin requiring pet stores to display additional information about each dog and cat for sale, including the name and address of the breeder was signed into law by Governor Chris Christie.

“After years of dedication to this legislation, we are pleased this measure to protect the purchaser from buying sick pets for their families is now law,” said Holzapfel. “By requiring a pet store to disclose the history at the point of sale, we can give consumers the opportunity to research the breeder and make an informed decision on where to make their purchase.”

The measure requires pet stores to disclose the origins of the dogs they sell and prohibit them from sourcing animals from breeders who fail to meet even the most basic care standards prescribed by federal and state law.

“Puppy and kitten mills are anonymously breeding and selling unhealthy pets to customers without providing information regarding the medial history of the animal. It can be devastating for a pet owner to watch their new dog or cat struggle with an illness in the early stages of its life,” added Assemblyman Wolfe.

The bill requires all information regarding the pet to be posted on the cage or enclosure a sign that includes the age, name of breeder and their contact information as well as the breeder’s USDA license number. In addition, consumers will be able to access the USDA inspection reports for all breeders and establishes a $500 penalty for failure to comply with these requirements.

“Pet owners deserve to know all of the background information about its breeder, quality of life before the sale and all medical history involving the pet before purchasing,” continued Assemblyman McGuckin. “With this legislation we will help put the bad breeders out of business and ensure that fewer families do not suffer from the financial burdens an unhealthy pet will place upon its owner.”

The Humane Society of the United States, the American Society for the Prevention of Cruelty to Animals and Friends of Animals United New Jersey lauded the signing of the “Pet Purchase Protection Act.”

“The Humane Society of the United States thanks Governor Christie for signing Senator Holzapfel, Assemblyman Wolfe, and Assemblyman McGuckin’s Pet Store Disclosure bill,” said Kathleen Schatzmann, New Jersey State Director for the Humane Society of the United States. “This new law will protect consumers by requiring pet stores to disclose the source of the puppies they sell for purchase, and will eliminate sales in New Jersey pet shops of puppies acquired from some of the worst puppy mills in the nation.”

“When New Jersey lawmakers voted unanimously in favor of S.1870, they took a stand against the inherent cruelty found in puppy mills, which show so little regard for the welfare of breeding dogs and often produce sick puppies later sold in our state,” said Debora Bresch, Esq., senior director of ASPCA Government Relations for the Mid-Atlantic region, and a New Jersey resident. “The ASPCA® (The American Society for the Prevention of Cruelty to Animals®) commends Sen. James Holzapfel, Asm. Gregory McGuckin, Asm. David Wolfe and Gov. Chris Christie for enacting a measure to allow for more transparency and accountability within the pet industry and ensure New Jersey consumers and their pets are protected, not exploited.”

Holzapfel, Asm. Wolfe and Asm. McGuckin for looking out for New Jersey consumers and puppy mill puppies by sponsoring this bill.”
