Cardinale’s Floor Speech on Unintended Consequences of Out-of-Network Bill

Senator Gerry Cardinale (R-39) delivered the following remarks on April 12, 2018, regarding S-485/A-2039, the Out-of-network Consumer Protection, Transparency, Cost Containment and Accountability Act:

“My compliments to the sponsor for recognizing the problem of out surprise changes that affect too many folks who come into contact with the maze of circumstances surrounding modern day health care.

“This bill corrects that problem, but like too much legislation, which we pass, it raises a number of other problems and unintended consequences.

“The details of the arbitration system established under this bill will enhance the insurance companies leverage in negotiating payments and ultimately fee agreements.

“The impact on the availability of needed medical services in NJ is potentially very important, but mostly to those who find themselves is need of modern, highly technical medical care.

“Most will never miss the surgeon or neurologist who cannot any longer maintain a New Jersey practice under this new regime. Some patients will simply go to a neighboring state those services, but others will simply die or suffer unnecessary morbidity. Only those who no do not get sick will be spared.

“That’s not the intention of the sponsor, but it’s the reality of this bill.

“It’s so unnecessary. With a small change, simply using the fair reimbursements standards we could change this into a truly bipartisan bill with few opponents.

“Therefore I move S485 back to Second reading for the purpose of amendment.”

Senator Cardinale’s motion was tabled by the Democratic Senators. S-485/A-2039 passed both houses without the common-sense fixes he proposed.
