Senate Approves Bucco Bill Requiring Dental Insurers to Issue Refund for Reduced Usage During Pandemic

“From March to May of 2020, many dental offices were forced to close due to the Governor’s executive order, which shuttered many businesses and stopped non-essential medical care,” said Bucco (R-25). “My legislation will make sure that New Jerseyans who were prevented from receiving routine dental care during those two months get properly reimbursed.”

Under the bill, A-4538/S-3131, every carrier writing dental insurance plans in New Jersey would issue a credit to each policyholder with a plan that was in effect on March 27, 2020. The credit would be an amount equivalent to the value of any reduced claims experienced due to the limitations of dental services for the period beginning on March 27, 2020 and ending on May 26, 2020. The credit may be returned to the policyholder in the form of a direct refund or credit toward future premiums.

“The people of New Jersey could not obtain basic dental care for two consecutive months, allowing dentists to only take emergency cases,” added Bucco. “The least we can do is credit policyholders for those two months that were lost.”
