NJ Legislation Bans TSA Scanners and Criminalizes Unreasonable Searches and Invasive Pat Downs

New Jersey Senator Michael Doherty (R-Warren, Hunterdon) announced today that he has introduced three pieces of legislation drafted to eliminate any immunity TSA agents might enjoy when violating New Jersey law during unnecessary and invasive airport screenings:

“For more than a month now, the TSA has quite literally stuck their finger in the eye of law-abiding American citizens while trampling on their constitutionally guaranteed liberties,” Doherty stated. “We call upon every state legislature in our great country to immediately act to put our federal government on notice that the dignity of our citizens shall not be the cost of a failed federal open border policy.”

Senator Joe Pennacchio (R-Morris/Passaic), a member of the Senate Budget and Appropriations Committee, is once again questioning why both of New Jersey’s United States Senators have failed to side with New Jersey taxpayers by demanding the Federal government waive the $271 million contribution toward the ill-conceived, failed ARC Tunnel project.

“This project came with an open ended commitment for cost overruns that our Governor and New Jersey taxpayers refuse to accept. Even after the U.S. Inspector General criticized the project, the Federal government along with our two U.S. Senators continue to ask for $271 million which would be paid for with money we simply don’t have,” said Pennacchio.

Senator Michael Doherty, a member of the Senate Budget and Appropriations Committee, issued the following statement regarding news that Governor Christie has retained outside counsel to fight the Federal Transit Administration’s (FTA) unreasonable demand that New Jersey taxpayers pay for its failed project:

“I am deeply disturbed by the FTA’s unreasonable, capricious and arbitrary demand that New Jersey taxpayers pay it for a project doomed to fail. The FTA set in motion a chain of events that inevitably led to the correct decision by Governor Christie to stop throwing good money after bad.

Oroho Business Tax Reform Measures to be Considered by the Senate

Senator Steve Oroho (R-Sussex) today lauded the inclusion of business tax reform measures he has authored in a package of jobs creation bills that will be considered by the Senate in December. The proposals, S-1646 and S-1540, would simplify the formula by which business taxes are calculated and give relief to small businesses, respectively.

“I am pleased that these important tax relief and reform measures will be considered by the Senate and Assembly next month,” said Senator Oroho. “My bills address what we in New Jersey have known for too long: that our tax code is chasing jobs and economic opportunity out of state. While budgetary constraints may necessitate that the reforms be phased in over several years, it is important that state government send a message to the business community that better days are ahead and that leaders in Trenton are serious about using our tax code to help rather than hinder job creation.”

Senate Republican Leader Tom Kean, Jr. (R-Westfield) and Senator Joe Kyrillos (R-Monmouth) today said that while they are encouraged that Legislative Democrats have finally realized the need to focus on combating unemployment with less than a month to go in the legislative calendar, comprehensive job creation measures proposed by Republicans have been allowed to languish in the Senate:

“I welcome ideas from any legislator that will help put the 9.6% of New Jersey residents who are unemployed back to work,” said Senator Kean. “Senator Sweeney and Speaker Oliver are correct in their statement today that ‘little attention has been paid to the issue of jobs and the economy’ by the Legislature they control. Republican Senators, meanwhile, have submitted countless job creation proposals that have received little or no consideration by the Majority. Unemployed workers do not care if a bill comes from a Democrat or Republican. Those seeking employment simply want the dignity of a job, and deserve elected leaders who will consider all available options to put them back to work.”

Holzapfel Bill Aims to Help Save the Barnegat Bay

Assemblyman Jim Holzapfel of the 10th Legislative District has introduced legislation in an effort to save the Barnegat Bay. The bill known as the “Save Barnegat Bay Act” would establish the “Save Barnegat Bay Fund” to support and help protect, preserve and remediate the Barnegat Bay estuary and its watershed.

The Save Barnegat Bay Fund is a special non-lapsing fund in the Department of Treasury which would be supported through four separate monetary collections. Donations would come from a portion of the sales tax on lawn fertilizer, the creation of the Save Barnegat Bay license plate, donations from the renewal of a boating license and $1 from each beach badge fee collected anywhere in the State will be donated to the fund.

Doherty Drafting New Legislation to Rein In TSA Abuses

Legislation to Be Introduced at December 6 Session of the Senate

Senator Michael Doherty (R-23) issued the following statement regarding legislation he is drafting to curb the abuses of civil liberties by the Transportation Security Administration (TSA):

“I am of the belief that our society is founded upon our ability to exercise our individual civil liberties freely, and I stand ready and willing to defend those liberties when they are threatened. It is with great sadness that I have come to recognize that one of our greatest threats has been presented by officials of the TSA who have begun to implement intrusive searches of law abiding Americans who are traveling within our borders,” Doherty stated.

“In response to the attitudes and actions of the TSA and top Obama Administration officials, I am drafting new legislation that will make it perfectly clear that in New Jersey, our constitutionally granted civil liberties are treasured and will be protected. I am calling upon my colleagues in the Legislature to step up and co-sponsor legislation that will protect the rights of citizens in New Jersey,” Doherty continued.

Bill Allows Tax Refunds to Be Credited Against Property Tax Debt

Legislation sponsored by Senators Michael Doherty (R-Warren, Hunterdon) and Diane Allen (R-Burlington, Camden) that would allow state income tax refunds to be credited against property tax debts passed the Senate today with broad bipartisan support.

“This bill is an integral part of Governor Christie’s toolkit that will give local officials the methods they need to keep property taxes under the two percent cap that was implemented in July,” Doherty began. “It is important that all of these bills are passed before the cap takes effect January 1, 2011 in order to avoid catastrophic layoffs or cuts in vital services.”

9th District Delegation Strongly Conveys Its Opposition to Any Consideration of Exit Toll

9th District Legislators Senator Christopher J. Connors, Assemblyman Brian E. Rumpf and Assemblywoman DiAnne C. Gove met with Executive Director Veronique Hakim and other officials of the New Jersey Turnpike Authority to discuss the prospect of building a park-n-ride off of Garden State Parkway Exit 58 for commuters as well as plans for infrastructure improvements at the Exit to address existing traffic problems.

Ocean County Freeholder Jack Kelly and Little Egg Harbor Mayor Ray Gormley also attended the meeting which was held at the 9th District Legislators’ Office.  Senator Connors, Assemblyman Rumpf and Assemblywoman Gove issued the following statement regarding their meeting with the Turnpike.

Bateman Bill to Protect Law Enforcement Animals Clears Senate

Legislation written by Senator Christopher “Kip” Bateman (R-Somerset) enhancing penalties for threatening animals used by law enforcement agencies has cleared the Senate.

“Dogs, horses, and other animals used by law enforcement serve critical functions not only in pursuing and apprehending criminals, but as goodwill ambassadors to the community,” said Senator Bateman. “Countless hours and dollars are invested in their training and maintenance, and have proven wildly effective in activities ranging from search and rescue to narcotics and explosives detection. These animals are treated as members of their respective departments while on duty, and those who threaten or seek to do them should face more severe punishment than the current law allows.”
