Encap’s Misrepresentations To State Officials May Be Fraud
Senate Republican Whip Kevin O’Toole, (R-40) issued the following statement regarding Inspector General Mary Jane Cooper’s report on the EnCap debacle.
“I am deeply concerned by the Inspector General’s testimony regarding the EnCap landfill remediation project. The lack of coordination and the lack of oversight by the Executive branch allowed the principals of EnCap to significantly misrepresent their capabilities and their financial resources.
“The testimony today indicates to me, that there is a substantial likelihood that some of Encap’s representations to state officials constitute fraud. Any criminal acts that occurred during this project must be swiftly prosecuted.
“Questions by members of the committee today demonstrated the Office of the Attorney General has been intimately involved in many aspects of EnCap’s involvement in the landfill closure bidding process. In order to avoid any appearance of a conflict of interest, I think that the Inspector General’s report should be forwarded to the United States Attorney, not the Attorney General.
“The loans that were extended to EnCap through state channels were unprecedented. The state must begin to ensure that any monies loaned to any entity involved in this project are recoverable. The Legislature must also institute protocols, some of them included in the Inspector General’s report, to ensure that any future projects are fully vetted and that they receive proper oversight.”
