Legislation that would make the theft of EZPass transponders illegal has been approved by the Senate Transportation Committee. The measure, S-515, is sponsored by Senator Andy Ciesla (R-10) and was drafted in response to the numerous complaints pertaining to stolen EZPass transponders.
Under the legislation, thieves convicted of stealing an EZPass would receive fines ranging anywhere from $500 to $10, 000.
“Unfortunately, detachable EZPass transponders have proven an easy target for thieves, ” said Ciesla. “My legislation will also ensure that EZPass customers have some protection if a stolen EZPass is used to make unauthorized charges against their account.”
The legislation protects EZPass customers by stating that they shall not be liable for unauthorized charges of $50 or more that occurred before the loss or theft was reported and for any charges after the loss or theft has been reported.
“A customer reporting a stolen EZPass would not be charged any fees for the stolen transponder or for a replacement transponder.” Ciesla added. “The EZPass system has helped reduce congestion on our toll roads and I am hopeful that people will continue to use it.”
This legislation was passed by a vote 5-0 and now heads to the full Senate for consideration.
