Senator Anthony Bucco (R-25), a member of the Budget and Appropriations Committee, expressed concern to revenue officials today about the state’s practice of stopping trucks and demanding payment for back taxes and penalties.
“Pulling over trucks and holding drivers hostage until the business proprietor pays taxes that they may not even realize they owe creates a terrible image of New Jersey, ” Bucco stated. “I am all for New Jersey collecting taxes that are due to the state, however, we also have to be concerned about our reputation as we try to attract companies and the jobs they create.
“Businesses are confused about New Jersey’s law. Until recently, courts have held that a business has to have a physical presence, such as a store, for the state to tax it. But new court rulings have confused the definitions of physical presence, and out-of-state companies that do businesses in New Jersey are subject to the same taxes.
“Though New Jersey’s Division of Taxation’s Special Projects Investigators are permitted to stop trucks, detain drivers, and impound trucks, these measures should be last resorts, especially when the tax rules are unclear.
“Gary Rose, New Jersey’s Economic Growth Czar, has publicly stated that New Jersey’s reputation is the biggest barrier to attracting new business to the state, ” Bucco continued. “Stopping trucks at our borders doesn’t help our reputation.”
