Now Law: Bateman Bill to Provide Equal Protections to Domestic & Civil Union Partners of Homicide Victims

Legislation signed into law by Governor Christie expands eligibility to the benefits established under the “Crime Victim’s Bill of Rights”

Governor Christie has signed legislation sponsored by Senator Christopher “Kip” Bateman (R-16) to include the domestic or civil union partner of a homicide victim among those eligible to receive compensation, as well as certain protections and rights from the criminal justice system.

Sen. Kip Bateman’s bill, now law, includes domestic or civil union partners among those eligible to receive benefits and protections established under the Crime Victim’s Bill of Rights .

“A person who has lost their beloved partner to homicide should have access to the same benefits and protections afforded to spouses and relatives,” Senator Bateman said. “A victim’s domestic or civil union partner is no less deserving than any other loved one coping with such an unthinkable loss. New Jersey’s criminal justice laws must evolve to meet the needs of all families of homicide victims. I am pleased that the Governor has signed my bill to correct this major oversight in state law.”

Senator Bateman’s legislation, S-180, revises the definition of “victim” under the “Crime Victim’s Bill of Rights” to be more consistent with the definition of “victim” in the New Jersey Constitution. Under the legislation, “victim” will now include the spouse, parent, legal guardian, grandparent, child or sibling of the decedent in the case of a criminal homicide or act of juvenile delinquency that would constitute criminal homicide if committed by an adult. In addition, the bill includes in the definition of “victim” a domestic partner or civil union partner. The act will take effect immediately.
