Legislation sponsored by Senator Diane Allen (R- Burlington) permitting active duty military service members to be married or enter into a civil union by proxy has been signed into law by Governor Christie.
Marriage by proxy allows an attorney to “stand in” for a service member and complete the legal necessities of marriage or civil union, thereby conferring tax treatment, health benefits, and power of attorney to a service member’s partner while he or she is serving in armed conflict or war.
Allen said that the new law will ensure that only the wedding ceremonies, not legal rights, are delayed as a result of military service.
“Service men and women join the armed forces knowing that they could be asked to put their lives on hold in times of war, including wedding plans, ” Allen said. “This legislation gives members of our armed forces and national guard some peace of mind. They will be able to enjoy the benefits of marriage or civil union while waiting to reunite and celebrate together, in person, when their tour of duty is complete.”
