Senate Bill 2175, which requires violators of the state’s identity theft law to pay restitution, has been approved by the Senate Judiciary Committee. Senator Diane Allen, Republican from Burlington County and the sponsor of the bill, issued the following statement:
“It’s unjust that identity thieves aren’t always required to pay restitution for the harm they’ve done,” Senator Allen said. “It’s gratifying that members of the Judiciary Committee voted to move my bill, which plugs this loophole. No one who steals another person’s identity should be allowed to keep his ill-gotten gains.”
State identify theft law currently does not require courts to order restitution. Senator Allen said the courts should always force identity thieves to compensate victims.
“The victims of these crimes are often left penniless or in debt,” Allen said. “Whatever resources are possessed by an identity thief should be used to compensate victims.”
