Legislation Requires State Agencies to Follow Statutes and Regulations, Rather than Their Own Documents, When Making a Decision
Legislation sponsored by Senator Dawn Marie Addiego (R-8) eliminating red tape that hinders business and economic development has been signed into law by Governor Christie.
“The new law requires state agencies to follow the law as it is already written, instead of making decisions based on their own internal documents,” said Senator Addiego.
The law mandates all State agency rules be published in the New Jersey Register, and prohibits the use of regulatory guidance documents, except under certain circumstances.
“We have heard complaints from the business community that some state agencies, in their analysis and approval or requests, were relying more on their own documents than the actual statutes and regulations,” said Senator Addiego.
“This unfair practice was circumventing the proper process, and often created an unnecessary hardship,” said Addiego.
